The TAR Catania administrative court has annulled the decisions behind a desalination plant at Capo Graziano bay on Filicudi, as became known on 16 October. A landowner had brought the case. The court gave three reasons: he had not been notified in person, there was no prior archaeological assessment, and the condition protecting Posidonia seagrass had been changed afterwards, from directional drilling to excavation and replanting. Annulled are the decision of the municipality of Lipari, the occupation of the plots and a regional decree of 19 June. The project is funded from the PNRR recovery fund.
Urgent funding does not replace a sound procedure. The municipality and the region now have to review the case; according to the court, the construction contract with Emm&A Consolidamenti does not lapse automatically.
